Polda Malut Pastikan Tarik Kembali SKCK Cagub Muhammad Kasuba
TERNATE-pl.com, Direktorat Intelijen dan Keamanan (Dirintelkam) Polda Maluku Utara (Malut), bakal menarik kembali Surat Keterangan Catatan Kepolisian milik calon Gubernur Muhammad Kasuba (MK).
Sikap tegas Polda Malut ini setelah mengetahui mantan Bupati Halmahera Selatan (Halsel) itu masih berstatus tersangka kasus dugaan korupsi pengadaan MV Halsel Express 01 senilai Rp 15. 193.137.960.00 (Lima belas miliar Seratus Sembilan Puluh Tiga Juta Seratus Enam Puluh Ribu).
Direktur Intelkam Polda Malut, Kombes Pol Yushfi Munif Nasution, mengatakan, SKCK milik Muhammad Kasuba sudah diterbitkan atas dasar surat rekomendasi tiga Satuan Kerja (Satker) Polda Malut.
“Penerbitan SKCK atas surat rekomendasi tiga satker yakni Direktorat Kriminal Umum, Direkterot Kriminal Khusus dan Direktorat Narkoba,”kata Yushfi saat dikonfirmasi poskomalut grup Senin (26/8/2024).
Yushfi menyampaikan, dari tiga surat rekomendasi tersebut tidak ada permasalahan atau tindak pidana yang dilakukan.
Selain itu kata Yushfi, yang bersangkutan tidak ada kasus pidana di kepolisian sehingga tiga Satker tersebut mengeluarkan surat rekomemdasi.
Meski demikian, pria berpangkat Kombes itu belakangan mendapat informasi terkait status tersangka MK dalam kasus dugaan korupsi pengadaan MV Halsel Expres 01 ditangani pihak Kejaksaan Tinggi (Kejati) Malut.
“Informasih ada kasusnya tapi ada di Kejaksaan, jadi konfirmasi juga ke Kejati,”tuturnya.
Ia mengaku sementara ini pihaknya telah menyurati kejaksaan untuk menanyakan ihwal kasus tersebut.
“Jadi kita tunggu kejelasan dari pihak Kejaksaan,”tandasnya. Jika hasil penjelasaan Kejaksaan bahwa kasus MK memang ada, Yushfi memastikan akan menarik kembali SKCK yang sudah dikeluarkan.
“Kita bersurat dulu ke Kejati nanti kalau sudah ada kejelasan dari Kejati, kita akan tarik lagi dan buat catatan tindak pidananya. Untuk surat turunnya kapan nanti tanya ke Kejati,”tegasnya mengakhiri.
Akademisi Unkhair Tenate Aslan Hasan SH.,MH., mendesak Polda Maluku Utara, mencantumkan status tersangka calon Gubernur Maluku Utara, Muhammad Kasuba (MK) dalam Surat Keterangan Catatan Kepolisian (SKCK).
Hal ini dilakukan agar tidak terjadi permasalahan di kemudian hari saat pencalonan Muhammad Kasuba pada pilgub ini. “Status hukum sesorang itu wajib dituangkan dalam materi SKCK,”tegasnya.
Kepolisian dalam hal ini Polda Malut, wajib mengeluarkan SKCK bagi cagub Malut, namun SKCK atas nama cagub Muhammad Kasuba harus memuat atau mencantumkan satatusnya sebagai tersangka dalam kasus yang telah dibatalkan SP3-nya oleh hakim praperadilan pada Pengadilan Negeri Ternate 2012 lalu.
“Jadi kalau pernah tersngaka maka status tersangkanya harus dicantumkan. Itu wajib,”sebutnya.
Kenapa wajib, karena jika status tersebut tidak termuat dalam SKCK dan saat pencalonan berlangsung akan menjadi masalah bagi calon itu sendiri. “Kenapa masalah karena informasi yang disajikan catatan kriminal itu informasi yang tidak valid,”ujarnya.
Olehnya itu, penting untuk dicantumkan dalam SKCK agar tidak menimbulkan kagaduhan saat pencalonan. “Kalau status sebagai tersangka terus dia bisa calon atau tidak tentu dia (MK) bisa calon,”tutupnya.
Seperti diberitakan sebelumnya, cagub Muhammad Kasuba masih berstatus tersangka kasus dugaan korupsi pengadaan MV Halsel Exspres. Kasus ini pernah dihentikan penyidikan (SP3) oleh penyidik Kejaksaan Tinggi Maluku Utara, pada 2009 silam. Halmahera Corruption Wacht (HCW) kemudian mengajukan permohonan praperadilan di Pengadilan Negeri Ternate.
Hasilnya, hakim praperadilan Pengadilan Negeri Ternate, menjatuhkan vonis Nomor: 01/Pid.PRA.TIPIKOR/2012/PN.Tte yang memuat tiga poin putusan yakni;
1. Mengabulkan permohonan praperadilan yang diajukan Halmahera Corruption Wacht (HCW) untuk SELURUHNYA.
2. Menyatakan Surat Perintah Penghentian Penyidikan (SP3) Nomor: Print-122/S.2/Fd.1/09/2009 tertanggal 04 Juni 2009 yang diterbitkan oleh TERMOHON dalam hal ini Kejaksaan Tinggi Maluku Utara, adalah TIDAK SAH.
3. Memerintahkan TERMOHON untuk melanjutkan pemeriksaan perkara pidana korupsi anggaran pengadaan kapal MV Halsel Expres 01 dengan tersangka H. Muhamad Kasuba MA dan Amiruddin Akt.
Putusan praperadilan atas SP3 kasus dugaan korupsi pengadaan MV Halsel Expres 01 dan dua unit speed boad dijatuhkan oleh hakim tunggal Amat Khusaeri SH,.Hum, pada 25 Juni 2012 silam. Usai membatalkan SP3, penyidik Kejati Malut tak lantas menindaklanjuti vonis hakim praperadilan untuk memeriksa perkara dugaan korupsi pengadaan MV Halsel Expres 01. (Zul)
